TERMS AND CONDITIONS

These Terms of Use, in conjunction with the Privacy Policy ("Agreement"), govern your use of the IHG INDUSTRY website (ihgind.com), data feeds, email newsletters, as well as other services provided to you on, from, or through such website ("Services"), as well as content appearing in the Services ("Content"). This Agreement is a legally binding contract between you and IHG INDUSTRY (hence " IHG INDUSTRY," "we," "us," or "our"). Our Privacy Policy is an essential component of this Agreement. By accessing, using, or contributing to the Services, you acknowledge that you have read and understand this Agreement (including our Privacy Policy), that you consent to be a party to this Agreement, and that you agree to be bound by and comply with the terms and conditions set forth herein. If, for any reason, you do not accept and agree to all the terms and conditions of this Agreement, please do not access or use the Services in any manner. For purposes of this Agreement, the term “Content” includes, without limitation, information, data, text, logos, photographs, videos, audio clips, animations, written posts, articles, comments, software, scripts, graphics, themes, and interactive features generated, provided or otherwise made accessible on or through the Services, including the User Content (as defined below).

GENERAL CONDITIONS

  • THE ‘Company’ means IHG INDUSTRY, a company registered in the UAE with a registered address at 7 Al Sagi Street. Al Quoz Industrial Area 3. Dubai, UAE
  • The 'Buyer' refers to the person, Firm, or Company to whom the seller supplies the Goods. This means the person, firm, or Company who purchases goods from the Company.
  • ‘Contract’ means the Contract between the Buyer and the Company for the sake of purchase of the Goods which the Buyer agrees to buy from the Seller.
  • ‘Goods’ means the Goods which the company has to supply in accordance with these terms.
  • ‘Non-Lighting Goods’ means any non-lighting goods which also include furniture and mirrors that the buyer agrees to buy.
  • ‘Third Party Delivery’ means the procedure whereby the Company delivers the goods on the behalf of the buyer to a third party nominated by the buyer.
  • The headings in these conditions are for convenience only and shall not affect their interpretations.
  • All orders are only accepted if the terms do not replace, supersede, override, or exclude any terms that the buyer has stipulated, included, or referenced. Any changes to terms in an order, in negotiations, or in a course of dealing between the seller and the buyer should only be made with the consent of both parties.

All orders thereafter made by the Buyer shall be deemed subject to these terms.

The Company reserves the right to vary the terms of these conditions. The varied conditions may come into force 30 days after the written notice

SPECIFICATIONS AND DETAILS

  • All descriptions and illustrations contained in catalogs, price lists, submittals, advertisements, or otherwise communicated to the Buyer are intended to merely present a general idea of the goods described therein and nothing contained in any of them shall form part of the contract.
  • Goods may vary in detail from the illustrations and measurements set out in the company’s sales literature.

Product Improvements

  • Continuous improvement is a part of the seller's policy. It is reserved for changes to be made to designs or products at any time without prior notice.
  • The Seller's policy contains continuous improvement. The right to change designs at any time without notice is reserved.

CHANGING OF PRICES

IHG INDUSTRY prices are subject to modification at any time. Prices may also vary due to a launching price, a promotional offer, or sales. Prices of items that are not in stock or that are available for a pre-order are valid during the promotional period after the order was placed. Should the price of those items change with respect to the pre-order price, the Customer will be informed and will have the possibility to cancel the order. We reserve the right to update prices displayed on the website from time to time and once updated, they cannot be claimed against an order that has already been confirmed or delivered.

 

TYPOGRAPHICAL ERRORS

IHG INDUSTRY strives for accuracy in all item descriptions, photographs, compatibility references, detailed specifications, pricing, links, and any other product-related information contained herein or referenced on our Website. Due to human error and other determinates, we cannot guarantee that all item descriptions, photographs, compatibility references, detailed specifications, pricing, links, and any other product-related information listed is entirely accurate, complete, or current, nor can we assume responsibility for these errors. In the event a product listed on our Web site is labeled with an incorrect price due to some typographical, informational, technical, or other error, IHG INDUSTRY shall at its sole discretion have the right to refuse and/or cancel any order for said product and immediately amend, correct and/or remove the inaccurate information.

Additionally, all hyperlinks to other Web sites from IHG INDUSTRY are provided as resources to customers looking for additional information and/or professional opinion. IHG INDUSTRY does not assume responsibility for the claims and/or representations made on these or any other Web sites.

 

PLACING AN ORDER

Placing an order can be done from the website, or by telephone at IHG INDUSTRY. Should you place an order from the website, you have to be sure that personal data is correct and updated. IHG INDUSTRY suggests the Customer proofread his/her form several times before validating an order. IHG INDUSTRY is neither responsible for sending e-mails to the wrong e-mail address nor for sending parcels to the wrong delivery address if the form is incorrectly filled-out.

 

PROCESSING TIME

You can expect your order to be processed within approximately 24-48 hours, provided the items are in stock and there are no problems with payment verification. IHG INDUSTRY does not guarantee the same-day shipping. Orders are not processed on weekends and holidays.
 

ORDER ACCEPTANCE POLICY

Your receipt of electronic or other forms of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. IHG INDUSTRY reserves the right at any time after receipt of your order to accept or decline your order for any reason. IHG INDUSTRY reserves the right at any time after receipt of your order, without prior notice to you, to supply less than the quantity you ordered of any item. We may require additional verifications or information before accepting any order.

 

ORDER ACKNOWLEDGEMENT

IHG INDUSTRY will keep you informed of your order status via e-mail. All tracking information will be emailed to your IHG INDUSTRY ID once your order has been processed or changed status. You may also acquire your order status and other live updates by logging in to your account on our Web site.

 

CHANGE ORDERS

Change Orders you may request a change to your order provided the order has not already been charged to your account. Please call us during IHG INDUSTRY hours of operation to request a change to your order. Please have your sales order (SO) or customer number ready for better assistance. We strongly discourage sending change order requests via email because it is unlikely we will receive the message in time to make an adjustment due to the sheer volume of emails we receive each day.

 

CANCEL ORDERS

You may request that an order be canceled provided the order has not already been processed and shipped. Simply call us during IHG INDUSTRY hours of operation to request an order cancellation. We strongly discourage sending order cancellation requests via email because it is unlikely we will receive the message in time to void the order due to the sheer volume of emails we receive each day.


 

PAYMENT

IHG INDUSTRY currently offers COD (“Cash on Delivery”) payments and card payments through a secure payment gateway. However, Cash the Delivery option is only applicable within the United Arab Emirates. In order to protect the visitors to the best of our knowledge, we implement several security policies and certificates. These layers of protection could be bypassed if the user's computer is/was infected with a virus or malicious software. IHG INDUSTRY or its associated partners and employees cannot be held responsible in such a scenario or circumstance.

IHG INDUSTRY reserves the right to refuse a delivery or honor an order from a Customer who has not paid part or the totality of a previous order or with whom a litigious dispute is in progress. IHG INDUSTRY also reserves the right to take any necessary steps including legal action in case of outstanding or non-payment of fees by you.
 

INVOICE

The order form filled out online by the Customer cannot be considered an invoice. Regardless of the purchase or payment methods, the Customer receives an invoice inside his/her parcel when it is delivered. A digital/hard copy of each invoice is registered in the IHG INDUSTRY database.
 

SECURITY

 

IHG INDUSTRY will take all reasonable precautions to ensure the security of any payment details included in your order nevertheless, barring direct negligence on our part, we cannot be held liable for any losses incurred as a result of unauthorized access to the information you may provide. DISPUTES

 

If any dispute, claim, controversy or difference (including in relation to any tortuous or statutory claim) ("Dispute") arises out of or in connection with or in relation to this User Agreement, including (without limitation) any question regarding the formation, existence, scope, performance, interpretation, validity or termination of this User Agreement or this clause, or any question regarding the legal relationships established by this User Agreement or the consequences of its nullity, then the parties shall first attempt amicably to settle the Dispute through good-faith negotiations over a period of thirty (30) calendar days commencing on the date that a party first sends to the other party written notice of the Dispute.

In the event that a Dispute has not been settled amicably by the relevant parties by the end of such thirty (30) calendar day period, the parties hereby agree that the Dispute shall be referred to and finally resolved by binding arbitration as set out below, under the Arbitration Rules of the Dubai International Financial Centre

Returns

Goods supplied in accordance with the Buyer's orders cannot be accepted for return without the Seller's written consent. If such consent is given, an administration charge will be made.

Returned goods must be sent carriage free and at the Buyer’s risk and will only be accepted if packed in the original carton/packing which in the seller’s opinion is in a saleable condition. Only goods belonging to the current design will be accepted for return.

If the seller without a reason does not want to accept the return, the buyer can not hold the seller accountable for not accepting the return.

Replacements

Replacements are only applicable when the claimed items are brought back to our showroom. The replacement request will be granted only if the technical evaluation is found irreparable and it is a pure manufacturing fault. Replacement of a product depends on the availability of the item. If the item is not in stock, it will be replaced only after the receipt of the next shipment. No cash refund is possible, but any other alternative product for the same value can be bought. Any claims/replacements will be honored only after the technical evaluation is done, which will take a minimum of 5-7 working days.

Misclaims

Any discrepancy in the document must be communicated in writing within 7 days of the document date. By signing this document, the customer accepts IHG INDUSTRY’s terms and conditions of sale and confirms the receipt of all the materials mentioned above in good condition and complete quantity and has no further claims whatsoever.

GOVERNING LAW

This User Agreement is governed by and construed in accordance with, UAE law. This clause will survive any expiry or cancellation of this User Agreement for any reason.
